This information that you have just accessed for the purposes of consulting or purchasing products, regulates the General Terms & Conditions of Use of the Online Store of “GREENHOUSE” (hereinafter, “online store”), trademark registered by FRADPLANTA, LDA., Crl ( Hereinafter, “FRADPLANTA, LDA.”), with registered office at BORDAS DO RIO 2450-310 VALADO DOS FRADES, legal entity and registered at the Commercial Registry Office of NAZARÉ with number 507 416 813.

USE OF THE ONLINE STORE

Using this online store gives you the status of Customer and implies acceptance, fully and without reservations, of all the provisions included in the General Terms & Conditions, and in the Privacy Policy, in force at each time you access the Online Store.

If you do not fully accept any of the conditions established, you should not access/use the online store.

GREENHOUSE reserves the right to change and update the General Terms & Conditions periodically and without prior notice to the Customer.

The processing of personal data carried out by GREENHOUSE complies with current data protection legislation, namely Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, on the protection of natural persons in regarding the processing of personal data and the free movement of such data (“General Data Protection Regulation”) and other applicable community and national legislation.

All information provided by the Customer must be accurate and truthful. The Customer is obliged to update the information provided to GREENHOUSE whenever it undergoes any changes. The Customer is expressly responsible for any false or inaccurate statements made and for any losses caused to GREENHOUSE or third parties, with the information provided.

GREENHOUSE is the entity Responsible for the Processing of its Customers' personal data, whose legal basis for processing is the execution of this purchase and sale contract.

In the event of violation of the General Terms & Conditions, GREENHOUSE reserves the right to take any and all legally prescribed action. Furthermore, it also reserves the right to, at its discretion, terminate access to or use of the online store, with or without notification to the Customer.

GRRENHOUSE applies the appropriate and necessary technical and organizational security measures to ensure information security. However, the Customer is aware that the use of the online store may not be 100% secure, so there is a possibility that the information sent/received may be intercepted by unauthorized parties, and this fact cannot be attributed to GREENHOUSE.

The contractual proposal contained in the online store is aimed only at people of legal age, with the Customer accepting that it can only be used by users over the age of eighteen and/or with full contractual capacity and who, therefore, can be responsible for the commitments resulting from the buy and sell.

ONLINE PURCHASE PROCEDURE

1st Step: Selection of items to include in your shopping cart (the price of which is indicated in Euros, including VAT at the legal rate in force).

The Customer hereby expressly accepts and acknowledges that:

- The images of the products presented in the online store are for illustrative purposes only and the Customer must carefully and fully read the information on the essential characteristics of the articles and, in case of doubt, contact the customer support line or contact the GREENHOUSE store in order to obtain any additional information or details;

- GREENHOUSE will make every reasonable effort to include accurate and updated information about the products available on the website;

- The prices of the items indicated in the online store correspond to the full amount payable by the Customer.

2nd Step: Registration / Form Filling

For the purpose of confirming your order, the Customer will have to fill out a form, in which they must indicate:

- Full name/business name of the Customer;

- Telephone contacts and email addresses of the Customer;

- Customer's NIF/NIPC;

- Full name or company name of the Customer to appear on the invoice;

- Customer's NIF/NIPC to appear on the invoice;

- Customer address to appear on the invoice.

3rd Step - Confirmation of the items and services included in the shopping cart, Buyer Data and Billing and Payment Data

The Customer undertakes to carefully check the data contained in their order summary, confirming the items and services selected in the shopping cart, Customer data and billing data, and must then return to the previous steps in order to carry out the respective rectification if any nonconformity is detected.

GREENHOUSE will acknowledge receipt of the order by email sent to the email provided by the Customer.

When GREENHOUSE does not request advance payment, the order will be settled upon delivery, preferably in cash.

The invoice will be sent or delivered upon collection or delivery of the purchased products.

  DELIVERY METHODS:

  - In-Store Purchase Survey

The customer can choose to collect their purchase online at the GREENHOUSE Store located in Bordas do Rio 2450-310 Valado dos Frades – Nazaré (FRADPLANTA building).

At the time of collection, the Customer must check all the merchandise contained in the packaging, their quantity and condition.

If you detect defects or damage to the products and/or if they do not match your order request, the Customer must identify the damage or defects. The Customer must also contact GREENHOUSE for Customer Service +351 262 577 881 or if preferred via email geral@greenhouse.com.pt.

- Home Delivery of Purchases

In case of unavailability of products for delivery, GREENHOUSE must inform the Customer, within a maximum period of 3 days from becoming aware of this unavailability, refunding the amounts paid, if the Parties do not agree on a new delivery deadline.

The Customer undertakes to appear at the location on the agreed date and time to receive the goods. If it is not possible to deliver the goods due to the Customer's responsibility, the costs related to second deliveries will be borne by the Customer. If, on the date and time agreed for Delivery, the Customer is absent from the agreed location, GREENHOUSE will leave at that location, whenever possible, a document proving their visit, in which it will request that the Customer contact the delivery service. Customer Support for scheduling a new Service provision date.

- Delivery verification

Upon receipt, whether for Store Collection or Home Delivery, the Customer must immediately check the condition of the purchased products, their quantity and condition. If you detect defects or damage to the items and/or if the items do not match your order request, the Customer must contact GREENHOUSE for Customer Service +351 262 577 881 or if preferred via general email @greenhouse.com.pt .

- Termination of the contract

In accordance with the provisions of article 10 of Decree-Law no. 24/2014, of February 14 (updated by Decree-Law no. 78/2018, of October 15) the Customer enjoys the right to free resolution, which may be exercised without the need to indicate the reason up to 14 (fourteen) days after the date of delivery of the items, in which case the Customer agrees to be responsible for paying all transport charges for collecting the items between the delivery address to GREENHOUSE headquarters.

EXCHANGES AND RETURNS

The customer may return/exchange any product, due to defect, within the legal deadlines for this purpose, however, if they wish to collect it, they will bear the shipping costs.

CLAIMS

The Customer may direct any complaints to GREENHOUSE, using the contact details available on the contact page or send it to its headquarters.

APPLICABLE LEGISLATION AND JURISDICTION

For any divergence arising in the contractual relations between the Parties, Portuguese legislation will apply. Any question or dispute arising from the application, interpretation, integration or execution of this Agreement, when it cannot be resolved by agreement between the parties, will be submitted to the Portuguese courts. The consumer may also resort to Alternative Dispute Resolution Entities, available at www.consumidor.pt.

In the event of a consumer dispute, the consumer may resort to the network of consumer dispute arbitration centers authorized to carry out information, mediation and arbitration activities in consumer disputes.

PRIVACY POLICY

GREENHOUSE collects the customer's personal data for the purpose of managing customer accounts, billing, providing information, as expressly authorized for this purpose, all in accordance with the terms indicated above and the legislation in force.

This information derives from the provisions of article 18 of Law 114/2015, of 8 September.

The Customer declares to know and accept fully and without reservations these General Terms & Conditions for Online Purchase and Sale.
